5th Circuit Court of Appeals Panel Intervenes in Texas Abortion Law Case

The Associated Press and Austin American-Statesman reported Thursday evening that a three-judge panel of the 5th Circuit Court of Appeals lifted an injunction against Texas recently passed abortion law, HB 2.

The judicial panel granted the State of Texas' request for an emergency stay to lift the injunction blocking the law’s requirement that abortion doctors gain admitting privileges at a hospital within 30 miles of the clinic.

State Representative Charles Perry talked about the 30-mile provision on Wednesday's edition of the Chad Hasty Show on KFYO.  Perry said he through the provision would be upheld because similar laws past muster in other states.

After the ruling became public, Governor Rick Perry today issued the following statement, “Today's decision affirms our right to protect both the unborn and the health of the women of Texas. We will continue doing everything we can to protect a culture of life in our state.”

The 5th Circuit will determine the constitutionality of HB 2 in early 2014.
